1. Acceptance of Terms
By accessing www.taxplaceusa.com or using any services provided by Tax Place USA (“Company,” “we,” “us,” or “our”), you (“Client” or “you”) agree to be bound by these Terms of Service. If you do not agree, do not use our website or services.
These Terms comply with Florida law including the Florida Deceptive and Unfair Trade Practices Act (FDUTPA), Fla. Stat. §§ 501.201 et seq., and applicable federal tax regulations.
2. Services
Tax Place USA provides tax preparation services, including but not limited to: individual federal and state income tax return preparation, business tax return preparation, IRS correspondence assistance, tax planning consultation, and bookkeeping services.
Services are provided subject to a separate Client Service Agreement signed prior to engagement.
3. Client Responsibilities
You agree to:
- Provide accurate, complete, and timely information necessary for tax preparation
- Notify us promptly of any changes to your tax situation
- Review all prepared returns before signing
- Sign all required authorization forms, including IRS Form 8879
- Pay all fees as agreed
You understand that Tax Place USA relies on the information you provide. We are not responsible for errors resulting from incomplete or inaccurate information provided by you.
4. Fees and Payment
4.1 Fees are established in your Client Service Agreement and are due upon completion of services unless otherwise arranged.
4.2 Accepted payment: Zelle to info@taxplaceusa.com.
4.3 Returned payments will incur a $35 returned payment fee.
4.4 Unpaid balances after 30 days may be referred to collections. You agree to pay all reasonable collection costs including attorneys’ fees as permitted under Fla. Stat. § 57.105.
5. IRS Representation
Our representation before the IRS is limited to the scope defined in your engagement agreement and any applicable Power of Attorney (Form 2848). We are not liable for IRS penalties, interest, or additional taxes assessed after filing unless resulting from our gross negligence.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY FLORIDA LAW, TAX PLACE USA’S LIABILITY TO YOU FOR ANY CLAIM ARISING FROM SERVICES SHALL BE LIMITED TO THE FEES PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM. WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
7. Disclaimer of Warranties
Services are provided “as is.” We make no guarantee of specific tax outcomes. Tax law is subject to change, and past results do not guarantee future outcomes.
8. Confidentiality
We maintain strict confidentiality of all client information pursuant to IRC § 7216, our Confidentiality Agreement, and Florida law.
9. Intellectual Property
All content on www.taxplaceusa.com including text, graphics, and logos is the property of Tax Place USA and protected by applicable intellectual property laws.
10. Dispute Resolution
Any dispute arising under these Terms shall be governed by the laws of the State of Florida. The parties agree to attempt good-faith resolution before pursuing legal action. Any litigation shall be filed in Broward County, Florida.
11. Severability
If any provision of these Terms is found invalid, the remaining provisions remain in full force.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of our services following notice of changes constitutes acceptance.
